Red Flag Rules for Health Care Providers

Red Flag Rules apply to many types of businesses in protecting
consumers from Fraud an Identity Theft...one of these areas is

Red Flags Identification

Identification involves an evaluation of covered accounts (i.e. billing and records accounts) and the methods available to open, access, modify or close those accounts.

Preliminary questions helpful in identifying red flags might include the following:
  • How is an individual’s identity verified before opening or accessing a covered account?
  • What information is required for such verification?
  • What is done with that information once it is collected?
  • What third party service providers have access to data?


Penalties For Noncompliance

The Act can subject organizations to civil monetary penalties at both the federal and state level.

Although the FTC has not yet begun formal enforcement, fines could be assessed against each of a noncompliant companies’ covered accounts, retroactively, as the Red Flags Rules are in force.

The FTC has indicated that they may initiate investigations based on consumer or third party complaints (which can be initiated easily at the FTC Website or other government agency).

Federal authorities may impose up to a $2,500 fine for each knowing violation. 15 U.S.C. §1681s(a)(2)(A). A state may impose up to a $1,000 fine for each willful or negligent violation. 15 U.S.C. §1681s(c)
(1)(B)(iii).

Red Flag Rules-Who Must be Compliant

We believe there is too little news and too little clarification
about the FTC Red Flag Compliance Rules...what are the
Red Flags Rules...and who must be Compliant under the rules?


All U.S. businesses and financial institutions must comply with the Fair and Accurate Transactions Act of 2003, known as FACTA or The FACT Act, which includes guidelines known as the Red Flag regulations, intended to combat identity theft for consumer accounts.

The FTC mandated compliance to be complete by
November 1st, 2008 and FTC Enforcement of the
Red Flag Rules is set to begin November 1, 2009.

Red Flag Rules Compliance

All U.S. businesses and financial institutions must soon be in Compliance with the Fair and Accurate Transactions Act of 2003, known as FACTA. It includes guidelines known as the Red Flag regulations-The Red Flag Rules, which are intended to combat identity theft for consumer accounts.

Identity Theft Red Flags and Address Discrepancies Under the Fair and Accurate Credit Transactions Act of 2003 (applies to Red Flag Compliance in 2009).

The President signed the FACT Act into law on December 4, 2003

The FACT Act added several new provisions to the Fair Credit Reporting Act of 1970 (FCRA), 15 U.S.C. 1681 et seq. Section 114 of the FACT Act, 15 U.S.C. 1681m(e), amends section 615 of the FCRA, and directs the Agencies to issue joint regulations and guidelines regarding the detection, prevention, and mitigation of identity theft, including special regulations requiring debit and credit card issuers to validate notifications of changes of address under certain circumstances.
