Medical Practice Red Flag Rules

Who’s Covered by the Red Flags Rule?

Under the Rule, the definition of “creditor” is broad, and includes
"examples of groups that may fall within this definition as utilities, health care providers, lawyers, accountants, and other professionals."

In addition, the definition includes anyone who regularly participates in the decision to extend, renew, or continue credit, including setting the terms of credit.

For example, a third-party debt collector who regularly renegotiates the terms of a debt would be a creditor under the Rule.

The AMA - Red Flags Rule


In Nov. 2007, the Federal Trade Commission (FTC) issued a set of regulations, known as the “Red Flags Rule,” requiring that certain entities develop and implement written identity theft prevention and detection programs to protect consumers from identity theft.

Originally scheduled for a Nov. 1, 2008 compliance date, the FTC has now delayed the enforcement date of the Red Flags Rule until Nov. 1, 2009.

The new compliance date of Nov. 1, 2009, which follows two earlier extensions to May 1 and then later to Aug. 1, is a result of continued advocacy by the AMA and others who continue to object to the applicability of this Rule to health care providers and other professionals.


Since the Rule was issued, the AMA has objected to the FTC's interpretation that physician practices are "creditors" when they accept insurance and bill patients after services are provided or if they allow patients to set up payment plans after services have been provided.

The FTC states that this delay is intended to "give creditors and financial institutions more time to review this guidance and develop and implement written Identity Theft Prevention Programs."


While the AMA intends to continue to make the case to Congress and the agency that the FTC should republish the rule so that there is sufficient opportunity to formally comment and state the AMA's objections to physician inclusion in the program, the AMA has prepared a guidance document.

Document Management for Red Flag Compliance

How you handle your clients applications and credit is crucial to

There are 26 FTC identified Red Flags which cover various forms
of consumer protections against having their identity stolen
or their identity misused by others via fraud.

The first four Red Flags cover the use and misuse of handling of
consumer reports, the first category of Document Management.

If you or your business is handling consumer reports in connection
with accounts, these are the first four Red Flags of document
management relative to potential fraud or identity theft....

1) A fraud or active alert is currently included with a consumer report
What will your business do? What action will you take?
This is what the FTC wants to know, this is why a Compliance

2) A consumer reporting agency provides a notice of a credit freeze
in response to a request for a consumer report.
This might indicate that suspicious activity has already occured.

3) A consumer reporting agency provides a notice of address
discrepancy... documents shown do not match the information on
file...possible i.d theft.
How will you handle this, how will you document this and how will
your Compliance Officer record this in your document management.

4) A consumer report indicates a pattern of activity that is inconsistent
with the (credit) history and usual pattern of activity (via the history)
of an applicant or customer...this MIGHT signal recent fraud or a
recent theft of identity.

is vital for FTC Compliance under Red Flag Rules.

Red Flag Rules for Health Care Providers

Red Flag Rules apply to many types of businesses in protecting
consumers from Fraud an Identity Theft...one of these areas is

Red Flags Identification

Identification involves an evaluation of covered accounts (i.e. billing and records accounts) and the methods available to open, access, modify or close those accounts.

Preliminary questions helpful in identifying red flags might include the following:
  • How is an individual’s identity verified before opening or accessing a covered account?
  • What information is required for such verification?
  • What is done with that information once it is collected?
  • What third party service providers have access to data?


Penalties For Noncompliance

The Act can subject organizations to civil monetary penalties at both the federal and state level.

Although the FTC has not yet begun formal enforcement, fines could be assessed against each of a noncompliant companies’ covered accounts, retroactively, as the Red Flags Rules are in force.

The FTC has indicated that they may initiate investigations based on consumer or third party complaints (which can be initiated easily at the FTC Website or other government agency).

Federal authorities may impose up to a $2,500 fine for each knowing violation. 15 U.S.C. §1681s(a)(2)(A). A state may impose up to a $1,000 fine for each willful or negligent violation. 15 U.S.C. §1681s(c)
(1)(B)(iii).
